This Privacy Policy describes Our policies and procedures on the collection, use, and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You. We use Your Personal Data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

- Account means a unique account created for You to access our Service or parts of our Service.
- Business, for the purpose of the CPRA (California Privacy Rights Act), refers to the Company as the legal entity that collects Consumers’ personal information and determines the purposes and means of its processing, that does business in the State of California.

- Do Not Track (DNT) is a concept promoted by US regulatory authorities for the Internet industry to allow internet users to control the tracking of their online activities across websites.
- Personal Data is any information that relates to an identified or identifiable individual. For the purposes of the CPRA, Personal Data means any information that identifies, relates to, describes, or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.
- Sensitive Personal Information has the meaning defined under the CPRA and includes, but is not limited to, government-issued identification numbers, financial account information, precise geolocation, racial or ethnic origin, religious beliefs, union membership, personal communications, genetic data, biometric data, and health or medical information.
- Sale, for the purpose of the CPRA, means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating a Consumer’s personal information to a third party for monetary or other valuable consideration.
- Sharing, for the purpose of the CPRA, means communicating a Consumer’s personal information to a third party for cross-context behavioral advertising.
- Service refers to the Website and the Mobile Application.
- Service Provider means any natural or legal person who processes data on behalf of the Company.
- Usage Data refers to data collected automatically from the use of the Service.
- Website refers to NorCal Holistics, accessible from http://norcalholistics.org.
- Mobile Application refers to the NorCal Holistics app available for download on iOS and Android devices.
- You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Age Verification
Our Service is intended solely for individuals who are 21 years of age or older, as required by California law for the purchase of cannabis and cannabis-related products. We do not knowingly provide services to, or collect personal information from, individuals under the age of 21.
As part of our legal compliance obligations, we collect certain identifying information to verify your age before allowing access to purchase-related features of our Service. This information may include your date of birth, government-issued identification number, and name, and is used solely for age verification purposes. We retain this information only as long as required by applicable law or our compliance obligations.
If we become aware that a person under the age of 21 has provided us with Personal Data or attempted to use our Service for purchases, we will take immediate steps to remove that information and deny access.
Medical Cannabis Customers
NorCal Holistics collects medical cannabis documentation solely to verify eligibility for medical cannabis purchases as required by California law. We treat this information as sensitive and apply heightened protections to it. We do not sell or share this information for commercial purposes. Our full medical cannabis data handling practices are detailed in a supplemental notice available upon request.

- Medical cannabis recommendation or MMIC number (for medical customers only)
- Delivery address and geolocation data (when using our Mobile Application or delivery service)

Usage Data
Usage Data is collected automatically when using the Service. Usage Data may include information such as Your Device’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.
When you access the Service through our Mobile Application or a mobile device, we may collect certain information automatically, including the type of mobile device you use, your mobile device’s unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers, and other diagnostic data.
Geolocation Data
When you use our Mobile Application or request delivery services, we may collect your precise or approximate geographic location. This data is used to confirm your location is within our licensed delivery service area, provide accurate delivery estimates, and facilitate the delivery of your order. You may control location permissions through your device settings, though disabling location access may limit delivery functionality.
Tracking Technologies and Cookies
We use Cookies and similar tracking technologies to track activity on Our Service and store certain information. Tracking technologies used include beacons, tags, and scripts to collect and track information and to improve and analyze Our Service.
Cookies or Browser Cookies. A cookie is a small file placed on Your Device. You can instruct Your browser to refuse all Cookies or indicate when a Cookie is being sent. However, if You do not accept Cookies, You may not be able to use some parts of our Service.
Web Beacons. Certain sections of our Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company to count users who have visited those pages or opened an email.
We use both Session and Persistent Cookies for the following purposes:
- Necessary/Essential Cookies (Session Cookies): Essential to provide you with services available through the Website and Mobile Application, and to enable you to use their features. They help authenticate users and prevent fraudulent use.

- For age and medical verification: to confirm that you are eligible to purchase cannabis products under California law.
- For the performance of a contract: the development, compliance, and undertaking of the purchase contract for products, items, or services you have purchased.
- To contact you: by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as push notifications via our Mobile Application, regarding updates or informative communications related to our services, including security updates.
- To provide you with news, special offers, and general information about other goods, services, and events which we offer that are similar to those you have already purchased or enquired about, unless you have opted not to receive such information.
- To fulfill legal compliance obligations, including reporting to METRC as required by the Department of Cannabis Control (DCC).
- To manage your requests: to attend to and manage your requests to us.
- For business transfers: We may use your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets.
- For other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and evaluating and improving our Service, products, services, and marketing.
Legally Mandated Disclosures — METRC
As a licensed cannabis retailer and delivery operator in California, We are required by the Department of Cannabis Control (DCC) to report certain transaction and inventory data to METRC, California’s state-mandated cannabis track-and-trace system. This reporting is a legal obligation under California Business and Professions Code § 26067 and applicable DCC regulations. Data disclosed to METRC may include transaction records, product information, and license-related identifiers. This disclosure is made pursuant to a legal requirement, not for commercial purposes.

Note: METRC is included not as a commercial Service Provider but as a state-mandated compliance system. Disclosure to METRC is required by California law.
Sharing Your Personal Data

- With Service Providers: We may share your personal information with Service Providers to monitor and analyze the use of our Service, to process orders and payments, to facilitate delivery, and to contact you.
- For legal compliance: We may disclose your personal information as required by applicable law, including mandatory reporting to METRC as described above.
- For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business.
- With Affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy.
- With business partners: We may share your information with our business partners to offer you certain products, services, or promotions.
- With Your consent: We may disclose Your personal information for any other purpose with Your consent.
Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.
Age verification and medical cannabis documentation may be retained for longer periods as required by DCC licensing requirements and applicable California law. Usage Data is generally retained for a shorter period of time, except when used to strengthen security, improve functionality, or when we are legally obligated to retain this data for longer periods.

This section applies to all visitors, users, and others who reside in the State of California. The California Privacy Rights Act (CPRA), which amended and expanded the California Consumer Privacy Act (CCPA), provides California residents with specific rights regarding their personal information.

Sale and Sharing of Personal Information
We may have sold or shared the following categories of personal information for cross-context behavioral advertising in the last twelve (12) months: Category A (Identifiers), Category B (Personal information), Category F (Internet or network activity). We do not sell or share Sensitive Personal Information (Category L) for commercial purposes.
Your Rights Under the CPRA
If you are a California resident, you have the following rights:
- The right to know. You have the right to request that we disclose information about our collection, use, sale, disclosure, and sharing of your personal information over the past 12 months.
- The right to delete. You have the right to request deletion of Your Personal Data, subject to certain exceptions including legal retention obligations.
- The right to correct. You have the right to request that we correct inaccurate personal information we maintain about you.
- The right to opt-out of sale or sharing. You have the right to direct us not to sell or share your personal information for cross-context behavioral advertising. To exercise this right, contact us using the information below.
- The right to limit the use of Sensitive Personal Information. You have the right to direct Us to limit Our use and disclosure of Your Sensitive Personal Information to that which is necessary to perform the services reasonably expected by an average consumer, subject to certain exceptions under applicable law. Note that certain Sensitive Personal Information collected pursuant to legal obligations may not be subject to limitation in all circumstances.

“Do Not Track” Policy (CalOPPA)
Our Service does not currently respond to Do Not Track (DNT) signals. However, some third-party websites do track Your browsing activities. You can set your preferences in your web browser to inform websites that you do not want to be tracked by visiting the preferences or settings page of your web browser.
Security of Your Personal Data
The security of Your Personal Data is important to Us. While we strive to use commercially acceptable means to protect Your Personal Data, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee its absolute security.

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. For cannabis purchase purposes, our Service is restricted to individuals 21 years of age or older.
